End User License Agreement (EULA)
This End User License Agreement (the "Agreement" or "EULA") is a legal agreement between the end user ("you") and AifuStudio (the "Licensor"), developer of the Aifu software, Republic of Chile, legal contact: [email protected]. This Agreement governs the software, in any version, edition, or platform, together with its updates and related documentation (collectively, the "Software").
Acuerdo de Licencia de Usuario Final (EULA)
El presente Acuerdo de Licencia de Usuario Final (el "Acuerdo" o "EULA") es un acuerdo legal entre el usuario final ("usted") y AifuStudio (el "Licenciante"), desarrollador del software Aifu, República de Chile, contacto legal: [email protected]. Este Acuerdo rige el software, en cualquier versión, edición o plataforma, junto con sus actualizaciones y documentación relacionada (conjuntamente, el "Software").
1. Acceptance
By installing, copying, accessing, or using the Software, you confirm that you have read, understood, and accepted this Agreement in full. You must be at least 13 years of age and meet the minimum age of digital consent in your jurisdiction; if you are under the age of majority, you represent that a parent or legal guardian has reviewed and accepted this Agreement on your behalf and supervises your use of the Software, including any enabling of Agentic Features and any purchases. If you do not accept this Agreement, do not install or use the Software, and uninstall it if already installed. Where the Software is obtained through a distribution platform (e.g., Steam or an app store), that platform's own agreements also apply; this Agreement supplements and does not replace them.
1. Aceptación
Al instalar, copiar, acceder o utilizar el Software, usted confirma que ha leído, comprendido y aceptado íntegramente este Acuerdo. Debe tener al menos 13 años y cumplir la edad mínima de consentimiento digital de su jurisdicción; si es menor de edad, usted declara que un padre o tutor legal ha revisado y aceptado este Acuerdo en su nombre y supervisa su uso del Software, incluidos la habilitación de Funciones Agénticas y las compras. Si no acepta este Acuerdo, no instale ni utilice el Software, y desinstálelo si ya lo instaló. Cuando el Software se obtiene a través de una plataforma de distribución (ej., Steam o una tienda de aplicaciones), también aplican los acuerdos propios de dicha plataforma; este Acuerdo los complementa y no los reemplaza.
2. License Grant
The Licensor grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Software on devices you own or are authorized to administer, strictly for personal, non-commercial purposes, in accordance with this Agreement, the Terms of Service, and the Privacy Policy. The Software is licensed, not sold. Notwithstanding the foregoing, you may create, publish, and monetize your own content (such as videos, streams, or reviews) that features the Software, and use the Software as an aid in your own content creation, provided such use complies with this Agreement and does not involve redistributing the Software or providing it as a service to third parties. All rights not expressly granted are reserved by the Licensor.
2. Otorgamiento de Licencia
El Licenciante le otorga una licencia limitada, personal, no exclusiva, intransferible, no sublicenciable y revocable para instalar y utilizar el Software en equipos de su propiedad o que esté autorizado a administrar, estrictamente para fines personales y no comerciales, de conformidad con este Acuerdo, los Términos de Servicio y la Política de Privacidad. El Software se licencia, no se vende. No obstante lo anterior, usted puede crear, publicar y monetizar su propio contenido (como videos, transmisiones o reseñas) que muestre el Software, y utilizar el Software como apoyo en su propia creación de contenido, siempre que dicho uso cumpla con este Acuerdo y no implique redistribuir el Software ni proporcionarlo como servicio a terceros. Todos los derechos no otorgados expresamente quedan reservados al Licenciante.
3. The Software; Updates
The Software provides an AI companion with conversational, productivity, and — where offered — agentic functionality generated in real time by third-party artificial intelligence models. Features may vary by platform, version, or edition and may change over time. Certain features require an internet connection, a user account, or available credits. The Software may download and install updates automatically; updates may add, modify, or remove features and are governed by this Agreement unless accompanied by separate terms.

4. Optional Agentic Features
The Software may offer "Agentic Features": optional functionality that allows the AI assistant, subject to your authorization, to perform actions on your device (such as querying system information, managing files within locations you authorize, operating applications, adjusting settings, or executing commands) or on services you connect. Agentic Features that can access or affect your device are disabled by default and operate only after you actively enable them. Availability of Agentic Features may vary by platform, version, or edition.
4. Funciones Agénticas Opcionales
El Software puede ofrecer "Funciones Agénticas": funcionalidad opcional que permite al asistente de IA, sujeto a su autorización, realizar acciones en su dispositivo (como consultar información del sistema, gestionar archivos dentro de ubicaciones que usted autorice, operar aplicaciones, ajustar configuraciones o ejecutar comandos) o en servicios que usted conecte. 5. Permission Controls and Authorization
Agentic Features are governed by graduated permission controls presented in the product interface and documentation, whose most restrictive setting — the default — disables them entirely. Each setting enables only the functionality described for it. Enabling a permission setting, authorizing a location or resource, or connecting an integration constitutes your express authorization for the corresponding functionality. The permission controls determine what functionality is available; sensitive actions may additionally require individual approval under Section 6.

6. Consent, Approvals, and User Controls
The Software is designed to request your individual confirmation before executing sensitive or potentially destructive actions, showing you the relevant details before execution. Confirming an action in an approval prompt constitutes your express, informed instruction to execute that specific action. Certain permission settings expressly described in the product — such as the highest authority level — may allow tools provided by integrations you have connected to execute without per-action approval; enabling such a setting constitutes your standing authorization for those executions, while sensitive local operations continue to require confirmation. The Software provides controls that may include: visible indicators of local activity, a local activity log, individual and bulk revocation of authorizations and integrations, and an emergency stop that halts agentic activity and returns the Software to its most restrictive state. You are responsible for reviewing approval prompts before confirming and for using these controls.
6. Consentimiento, Aprobaciones y Controles del Usuario
El Software está diseñado para solicitar su confirmación individual antes de ejecutar acciones sensibles o potencialmente destructivas, mostrándole los detalles relevantes antes de la ejecución. Confirmar una acción en un aviso de aprobación constituye su instrucción expresa e informada de ejecutar esa acción específica. Ciertas configuraciones de permisos descritas expresamente en el producto — como el nivel de autoridad más alto — pueden permitir que las herramientas provistas por integraciones que usted conectó se ejecuten sin aprobación por acción; habilitar dicha configuración constituye su autorización permanente para esas ejecuciones, mientras que las operaciones locales sensibles siguen requiriendo confirmación. 7. Device, File, and System Operations
Where Agentic Features operate on your device, they are designed to act within the locations and resources you authorize — except for advanced operations expressly enabled at the highest permission level, which may reach beyond previously authorized locations, subject to the applicable approvals — and to apply safeguards intended to reduce risk (which may include recoverable deletion, automatic backups before modification, blocking of common credential and key material, and post-action verification), without elevation of privileges. Such safeguards are provided on a best-effort basis and do not guarantee the absence of errors, unintended effects, or data loss.

8. Advanced Capabilities
Certain permission settings may enable advanced capabilities — such as restricted command execution — intended for experienced users. Where offered, such capabilities are subject to restrictive policies (which may include denial of privilege elevation and mandatory confirmation of critical operations). You acknowledge that advanced capabilities can have real effects on your device and environment, and you assume full responsibility for the operations you enable and approve.
8. Capacidades Avanzadas

9. Integrations and External Services
You may optionally connect third-party integrations and services (including integrations based on open standards such as the Model Context Protocol). Integrations are chosen, configured, and connected at your direction and run under your responsibility. Third-party services are governed by their own terms and privacy policies, which you accept by connecting them; data the AI sends to a connected integration is shared with that third party. A "Verified" label indicates that an integration has been reviewed against Aifu's internal technical and security criteria at the time of review, but does not guarantee its continued security, availability, behavior, or fitness for a particular purpose; other labels, listings, or catalog entries are informational only. To the maximum extent permitted by applicable law, the Licensor is not responsible for third-party services, their security, availability, or data practices. Authentication credentials managed for integrations are stored locally using platform-provided secure storage where available; they are not sent to Aifu's cloud backend, but may be transmitted directly to the selected third-party service when required for authentication.
9. Integraciones y Servicios Externos
Usted puede conectar opcionalmente integraciones y servicios de terceros (incluidas integraciones basadas en estándares abiertos como el Model Context Protocol). Las integraciones son elegidas, configuradas y conectadas por indicación suya y funcionan bajo su responsabilidad. 10. Risk of Data Loss or Unsaved Work
You acknowledge that operations you enable, authorize, or approve may cause loss or corruption of data or unsaved work, notwithstanding the safeguards described in this Agreement. You agree to maintain independent backups of important information. Any liability arising from such loss or corruption is subject to the limitations and mandatory-law exceptions set out in Section 17.

11. Nature of AI-Generated Content
The Software relies on generative, probabilistic artificial intelligence models operated by third parties. Responses, proposed actions, tool selections, and results may be inaccurate, incomplete, unexpected, or unsuitable for your purpose, and may vary for identical inputs. AI output does not constitute professional, legal, medical, financial, or technical advice, and must not be relied upon for decisions with legal, financial, safety, or health consequences without independent verification.
11. Naturaleza del Contenido Generado por IA
El Software se apoya en modelos de inteligencia artificial generativos y probabilísticos operados por terceros. Las respuestas, las acciones propuestas, la selección de herramientas y los resultados pueden ser inexactos, incompletos, inesperados o inadecuados para su propósito, y pueden variar ante entradas idénticas. Las salidas de la IA no constituyen asesoramiento profesional, legal, médico, financiero ni técnico, y no deben utilizarse para decisiones con consecuencias legales, financieras, de seguridad o de salud sin verificación independiente.
12. User Responsibility and Supervision
You are the final decision-maker for all agentic activity. You agree to: review approval prompts before confirming; supervise agentic activity and make use of the review, revocation, and emergency-stop controls provided; enable Agentic Features only on devices and environments you own or are duly authorized to administer; and comply with all policies applicable to such devices and environments. Any liability arising from such functionality or operations is subject to the limitations and mandatory-law exceptions set out in Section 17.
12. Responsabilidad y Supervisión del Usuario
Usted es el decisor final de toda la actividad agéntica. Usted se compromete a: revisar los avisos de aprobación antes de confirmar; supervisar la actividad agéntica y hacer uso de los controles de revisión, revocación y parada de emergencia provistos; habilitar Funciones Agénticas únicamente en dispositivos y entornos de su propiedad o que esté debidamente autorizado a administrar; y cumplir todas las políticas aplicables a dichos dispositivos y entornos. Cualquier responsabilidad derivada de dicha funcionalidad u operaciones queda sujeta a las limitaciones y a las excepciones de derecho imperativo establecidas en la Sección 17.
13. Acceptable Use and Prohibited Activities
You must use the Software in compliance with applicable law. You must not, and must not attempt to, directly or through the Software's AI or any connected integration:
- Access, probe, or interfere with systems, accounts, networks, devices, or data without express authorization.
- Damage, disable, or impair systems, devices, networks, or services, or create, distribute, or execute malicious software.
- Interfere with, bypass, or disable security features, permission controls, approval mechanisms, or guardrails of the Software.
- Interfere with, manipulate, or evade anti-cheat or game-integrity mechanisms, or obtain unfair advantages in online games or other services.
- Decompile, reverse engineer, or attempt to derive the source code of the Software, except to the extent such restriction is prohibited by law.
- Generate or distribute unlawful content or content that infringes third-party rights, or use the Software on behalf of third parties without authority.
Breach of this Section entitles the Licensor to terminate this license immediately.
13. Uso Aceptable y Actividades Prohibidas
Usted debe utilizar el Software conforme a la ley aplicable. No debe, ni debe intentar, directamente o a través de la IA del Software o de cualquier integración conectada:
- Acceder, explorar o interferir con sistemas, cuentas, redes, dispositivos o datos sin autorización expresa.
- Dañar, inhabilitar o deteriorar sistemas, dispositivos, redes o servicios, o crear, distribuir o ejecutar software malicioso.
- Intervenir, eludir o inhabilitar funciones de seguridad, controles de permisos, mecanismos de aprobación o guardarraíles del Software.
- Interferir con, manipular o evadir sistemas anti-cheat o mecanismos de integridad de juegos, u obtener ventajas indebidas en juegos en línea u otros servicios.
- Descompilar, realizar ingeniería inversa o intentar derivar el código fuente del Software, salvo en la medida en que tal restricción esté prohibida por la ley.
- Generar o distribuir contenido ilícito o que infrinja derechos de terceros, o utilizar el Software por cuenta de terceros sin facultades para ello.
El incumplimiento de esta Sección faculta al Licenciante para terminar esta licencia de inmediato.
14. Privacy and Data Processing
The processing of personal information — including the data involved in Agentic Features, what remains on your device, what is transmitted to the Licensor's services and AI sub-processors, automated filtering safeguards, integrations, and retention — is governed by the Aifu Privacy Policy, which forms an integral part of this Agreement.

15. Intellectual Property; Feedback
The Software and all Licensor-owned elements of it, including its code, original design, interface, documentation, trademarks, and proprietary models and algorithms, are the exclusive property of the Licensor or its licensors and are protected by intellectual property laws. User-provided content and third-party content remain the property of their respective owners and are subject to any applicable third-party license terms. This Agreement does not transfer any ownership right to you. If you provide suggestions or feedback, you grant the Licensor a perpetual, irrevocable, royalty-free right to use them without restriction or compensation. The Software may include third-party components licensed under their own terms.
15. Propiedad Intelectual; Comentarios
El Software y todos los elementos de este que sean propiedad del Licenciante, incluidos su código, diseño original, interfaz, documentación, marcas y modelos y algoritmos propietarios, son propiedad exclusiva del Licenciante o de sus licenciantes y están protegidos por las leyes de propiedad intelectual. El contenido aportado por el usuario y el contenido de terceros siguen siendo propiedad de sus respectivos titulares y quedan sujetos a los términos de licencia de terceros aplicables. Este Acuerdo no le transfiere ningún derecho de propiedad. Si usted proporciona sugerencias o comentarios, otorga al Licenciante un derecho perpetuo, irrevocable y libre de regalías para utilizarlos sin restricción ni compensación. El Software puede incluir componentes de terceros licenciados bajo sus propios términos.
16. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF AI-GENERATED CONTENT, OR UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION. THE LICENSOR DOES NOT WARRANT THAT THE SAFEGUARDS DESCRIBED IN THIS AGREEMENT WILL PREVENT EVERY UNDESIRED OUTCOME. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN THAT CASE THE ABOVE EXCLUSIONS APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
16. Exclusión de Garantías
EL SOFTWARE SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUIDAS, SIN LIMITACIÓN, GARANTÍAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN PARTICULAR, NO INFRACCIÓN, EXACTITUD DEL CONTENIDO GENERADO POR IA U OPERACIÓN ININTERRUMPIDA, LIBRE DE ERRORES O SEGURA. EL LICENCIANTE NO GARANTIZA QUE LAS SALVAGUARDAS DESCRITAS EN ESTE ACUERDO EVITEN TODO RESULTADO NO DESEADO. ALGUNAS JURISDICCIONES NO PERMITEN LA EXCLUSIÓN DE CIERTAS GARANTÍAS; EN TAL CASO, LAS EXCLUSIONES ANTERIORES APLICAN EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SOFTWARE, OPERATIONS YOU ENABLED, AUTHORIZED, OR APPROVED, OR THIRD-PARTY SERVICES YOU CONNECTED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) THE LICENSOR'S AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE AMOUNTS YOU ACTUALLY PAID TO THE LICENSOR DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THIS AGREEMENT LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, NOR CONSUMER RIGHTS THAT CANNOT BE WAIVED.
17. Limitación de Responsabilidad
EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE: (A) EN NINGÚN CASO EL LICENCIANTE SERÁ RESPONSABLE POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENCIALES, EJEMPLARES O PUNITIVOS, NI POR PÉRDIDA DE DATOS, BENEFICIOS, REPUTACIÓN O NEGOCIO, DERIVADOS DE O RELACIONADOS CON EL SOFTWARE, CON OPERACIONES QUE USTED HABILITÓ, AUTORIZÓ O APROBÓ, O CON SERVICIOS DE TERCEROS QUE USTED CONECTÓ, AUN CUANDO SE HUBIERA ADVERTIDO DE LA POSIBILIDAD DE TALES DAÑOS; Y (B) LA RESPONSABILIDAD TOTAL AGREGADA DEL LICENCIANTE BAJO O EN RELACIÓN CON ESTE ACUERDO NO EXCEDERÁ LOS MONTOS EFECTIVAMENTE PAGADOS POR USTED AL LICENCIANTE DURANTE LOS DOCE (12) MESES ANTERIORES AL HECHO QUE ORIGINE LA RECLAMACIÓN. NADA EN ESTE ACUERDO LIMITA RESPONSABILIDADES QUE NO PUEDAN LIMITARSE CONFORME A LA LEY APLICABLE, NI DERECHOS DEL CONSUMIDOR IRRENUNCIABLES.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Licensor and its affiliates from claims brought by third parties arising out of: (a) your deliberately unlawful use of the Software; (b) your access to systems, accounts, networks, or data without authorization; (c) any infringement of third-party rights arising from content you upload or publish through the Software (such as to the Steam Workshop), regardless of your intent or knowledge; (d) your creation or distribution of malicious software; or (e) your material breach of this Agreement.
18. Indemnidad
En la medida permitida por la ley aplicable, usted se compromete a indemnizar y mantener indemne al Licenciante y a sus filiales frente a reclamaciones de terceros que surjan de: (a) su uso deliberadamente ilícito del Software; (b) su acceso a sistemas, cuentas, redes o datos sin autorización; (c) cualquier infracción de derechos de terceros derivada del contenido que usted cargue o publique a través del Software (por ejemplo, en el Steam Workshop), con independencia de su intención o conocimiento; (d) su creación o distribución de software malicioso; o (e) su incumplimiento material de este Acuerdo.
19. Term and Termination
This Agreement is effective from the first installation or use of the Software and remains in force until terminated. The Licensor may terminate this license immediately upon your breach of this Agreement, the Terms of Service, or applicable law. You may terminate it at any time by uninstalling the Software. Upon termination, you must cease all use and uninstall the Software. Sections 10, 13, 15, 16, 17, 18, 20, and 21 survive termination.
19. Vigencia y Terminación
Este Acuerdo rige desde la primera instalación o uso del Software y permanece vigente hasta su terminación. El Licenciante puede terminar esta licencia de inmediato ante su incumplimiento de este Acuerdo, de los Términos de Servicio o de la ley aplicable. Usted puede terminarlo en cualquier momento desinstalando el Software. Al terminar, debe cesar todo uso y desinstalar el Software. Las Secciones 10, 13, 15, 16, 17, 18, 20 y 21 sobreviven a la terminación.
20. Governing Law; General Provisions
This Agreement shall be governed by the laws of the Republic of Chile, without regard to its conflict of law provisions. Subject to mandatory consumer jurisdiction and venue rules, any dispute arising out of or in connection with this Agreement shall be submitted to the competent courts of Puerto Varas, Chile. Consumers retain any right granted by applicable law to bring claims before another competent court. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force. Failure to enforce any provision shall not constitute a waiver. You may not assign this Agreement without the Licensor's consent; the Licensor may assign it in connection with a merger, acquisition, or sale of assets. The Licensor shall not be liable for delays or failures caused by events beyond its reasonable control.
20. Legislación Aplicable; Disposiciones Generales
Este Acuerdo se regirá por las leyes de la República de Chile, sin dar efecto a sus principios de conflictos de leyes. Con sujeción a las normas imperativas de jurisdicción y competencia en materia de consumo, cualquier disputa que surja de o en relación con este Acuerdo se someterá a los tribunales competentes de Puerto Varas, Chile. Los consumidores conservan cualquier derecho que la ley aplicable les otorgue para presentar reclamaciones ante otro tribunal competente. Si alguna disposición de este Acuerdo fuera declarada inválida o inexigible, las restantes conservarán plena vigencia. La falta de ejercicio de cualquier disposición no constituirá renuncia. Usted no puede ceder este Acuerdo sin el consentimiento del Licenciante; el Licenciante puede cederlo en el marco de una fusión, adquisición o venta de activos. El Licenciante no será responsable por retrasos o incumplimientos causados por eventos fuera de su control razonable.
21. Changes to this Agreement; Prevailing Language
The Licensor may update this Agreement to reflect changes in the Software, applicable law, security requirements, or business operations. The current version, with its effective date, will always be published at the Software's official site. Material changes will be notified in advance through the Software or the official website and, where required by applicable law, will require renewed acceptance. Changes will not retroactively reduce accrued consumer rights. This Agreement is published in English and Spanish; in case of any discrepancy or conflict of interpretation, the Spanish version shall prevail.

21. Cambios a este Acuerdo; Idioma Prevalente
El Licenciante puede actualizar este Acuerdo para reflejar cambios en el Software, la ley aplicable, requisitos de seguridad u operaciones del negocio. La versión vigente, con su fecha de entrada en vigor, estará siempre publicada en el sitio oficial del Software. Los cambios sustanciales se notificarán con antelación a través del Software o del sitio web oficial y, cuando la ley aplicable lo exija, requerirán una nueva aceptación. Los cambios no reducirán retroactivamente derechos ya adquiridos del consumidor. Este Acuerdo se publica en inglés y en español; en caso de discrepancia o conflicto de interpretación, prevalecerá la versión en español.
